1. Agreement Overview

These Terms and Conditions ("Agreement") govern your purchase of electric forklifts and related equipment from American Forklift ("Company," "we," "us," or "our"). By placing an order, you ("Customer," "you," or "your") agree to be bound by these terms.

American Forklift is a leading provider of electric forklifts, specializing in eco-friendly material handling solutions for warehouses, construction sites, and industrial facilities across the United States.

2. Warranty Policy

What's Covered:

• Electric motor and controller
• Hydraulic system components
• Electrical system and wiring
• Structural frame and mast components
• Steering and brake systems

What's NOT Covered:

• Wear-and-tear parts (tires, brake pads, filters, belts)
• Minor cosmetic damages (scratches, dents, paint chips)
• Damage from misuse, accidents, or unauthorized modifications
• Batteries (warranty applies only to manufacturing defects)

For warranty claims, please contact our support team with your order number and photos of the issue. We'll respond within 2 business days.

3. Shipping & Delivery Terms

Delivery Process:

• Your machine arrives uncrated and ready to use
• Simply drive it down the ramp on delivery day
• Professional delivery team will assist with unloading
• Please inspect the forklift before signing the Bill of Lading

Delivery Timeline:

• Local (California): 1-2 business days
• West Coast: 2-4 business days
• Midwest: 4-6 business days
• East Coast: 5-7 business days
• Other States: 6-8 business days

Hawaii & Alaska:

For customers in Hawaii or Alaska, we can arrange delivery to a forwarder of your choice. You coordinate the final shipping from there. Additional fees may apply.

4. Payment Terms

American Forklift offers secure and convenient payment options for all customers:

Secure payments are processed through typhonmachinery.com, our trusted payment partner. All transactions are encrypted and PCI-compliant.

5. Return & Refund Policy

We want you to be completely satisfied with your purchase. If you need to return your forklift, here's what you need to know:

• 30-Day Return Window: You have 30 days from the date of delivery to request a return
• Condition: Forklift must be in original condition with minimal usage
• Restocking Fee: No restocking fee for returns within 30 days
• Return Shipping: Customer responsible unless item arrived damaged
• Refund Processing: 5-7 business days after inspection

For damaged items, note damage on the Bill of Lading before the driver leaves and contact us within 48 hours.

6. Delivery Inspection & Damage Claims

Upon delivery, please follow these important steps:

• Inspect Immediately: Check your forklift for any visible damage
• Note on BOL: Document ANY damage on the Bill of Lading before signing
• Take Photos: Capture clear photos of any damage
• Contact Us: Report issues within 48 hours of delivery

Failure to note damage on the Bill of Lading may affect your ability to file a damage claim with the shipping carrier.

7. Customer Responsibilities

As a customer, you agree to:

• Provide accurate shipping and contact information
• Ensure someone is available to accept delivery
• Inspect equipment upon arrival
• Follow proper maintenance and safety guidelines
• Use equipment only for its intended purpose
• Comply with all local safety regulations

8. Limitation of Liability

To the maximum extent permitted by law, American Forklift shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Damages from misuse, accidents, or unauthorized modifications
• Downtime or loss of use of equipment

Our total liability shall not exceed the purchase price of the equipment.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising from this Agreement shall be resolved in the courts of Los Angeles County, California.

10. Modifications to Terms

American Forklift reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the updated terms.
